By creating or participating in an online fundraising campaign benefitting InMotion® through the RunSignup platform, I, the undersigned, agree to the following terms:

• Assumption of Risk: I understand that my participation in any fundraising activities is voluntary and may involve inherent risks, including but not limited to physical activity, outreach efforts, or promotion of events. I assume full responsibility for any and all risks, injuries, or damages, known or unknown, which I might incur as a result of participating in such activities.
• Release and Waiver: I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release and discharge InMotion®, its officers, directors, employees, volunteers, and affiliates, as well as RunSignup and its affiliates, from any and all claims, demands, liabilities, damages, or causes of action arising out of or in connection with my participation in the fundraiser or any activities associated with it.
• Indemnification: I agree to indemnify, defend, and hold harmless InMotion®, RunSignup, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, losses, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to (a) my participation in the fundraising campaign, (b) any materials or content I create or distribute, and/or (c) my violation of any applicable law or the rights of any third party.
• Use of Name and Likeness: I grant InMotion® and RunSignup the right to use my name, likeness, image, and any materials I share for promotional or marketing purposes related to the fundraiser, in any media now known or hereafter developed, without compensation.
• Compliance with Terms: I agree to comply with all applicable laws, platform policies, and guidelines as provided by InMotion® and RunSignup. I understand that failure to comply may result in the removal of my fundraiser.

I acknowledge that I have read and understood this Waiver and Release of Liability / Indemnity Agreement, and that I am voluntarily signing it with full knowledge of its significance.
